These Terms and Conditions ("Terms") govern your access to and use of the PromptQuestAi platform and related digital services (collectively, the "Service") provided by PromptQuestAi ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using PromptQuestAi, you confirm that you are at least 13 years of age, that you have the legal capacity to enter into a binding agreement, and that you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account Registration

To access most features of PromptQuestAi, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share access to your account
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to refuse registration or terminate accounts at our discretion.

3. Licence to Use the Service

Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use PromptQuestAi solely for your personal or internal business purposes. This licence does not include the right to sublicense, resell, or commercially exploit the Service.

4. Credits and Subscriptions

Free Credits

Upon creating a verified account, you receive 50 free credits at no charge. Free credits do not roll over and expire 90 days after account creation or upon plan upgrade, whichever comes first.

Paid Subscriptions

Paid plans provide a monthly or annual credit allocation and access to additional features. Subscriptions are billed in advance on a recurring basis (monthly or annually). By subscribing, you authorise us to charge your payment method at the stated price for each billing cycle until you cancel.

Credit Usage

Each prompt transformation consumes a set number of credits as displayed at the time of use. Credits are consumed when you submit a transformation request, regardless of whether you copy or use the resulting output. Credits are non-transferable, have no cash value, and do not roll over between billing periods except where explicitly stated.

Price Changes

We may change subscription pricing at any time. We will give you at least 30 days' advance notice before any price change takes effect. Your continued use of the paid Service after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree to use PromptQuestAi only for lawful purposes and in a way that does not infringe the rights of others. You must not:

• Use the Service to generate content that is illegal, harmful, abusive, defamatory, obscene, or that violates any third-party rights
• Attempt to reverse-engineer, decompile, or extract the source code of the platform
• Use automated scripts, bots, or scrapers to access or harvest data from the Service
• Circumvent credit usage limits or access controls
• Share, resell, or redistribute generated outputs in a way that misrepresents their origin or violates these Terms
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service in any way that could expose PromptQuestAi to legal liability

Violation of these rules may result in immediate account suspension or termination without refund.

6. Your Content

You retain ownership of any content you submit to PromptQuestAi ("Input Content"). By submitting Input Content, you grant us a limited, non-exclusive licence to process it solely for the purpose of delivering the Service to you. We do not claim any intellectual property rights over your input or the enhanced prompts returned to you.

You are solely responsible for ensuring that your Input Content does not violate any applicable laws or third-party rights, including copyright, privacy, and confidentiality obligations.

7. Intellectual Property

All elements of the PromptQuestAi platform — including but not limited to the software, design, interface, branding, logos, and underlying algorithms — are the intellectual property of PromptQuestAi and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of PromptQuestAi's intellectual property to you.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any enhanced prompt returned by the Service.

AI-generated content may be imperfect, inaccurate, or unsuitable for your purposes. You are responsible for reviewing and validating any output before use.

9. Limitation of Liability

To the fullest extent permitted by law, PromptQuestAi and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or business interruption — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to PromptQuestAi in the 12 months preceding the event giving rise to the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless PromptQuestAi and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your Input Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or if we determine it is necessary to protect the platform or other users. Upon termination, your right to access the Service ceases immediately and any unused credits are forfeited.

You may close your account at any time by contacting us at hello@promptquest.com. Closing your account does not automatically entitle you to a refund; please refer to our Refund Policy.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated effective date and, where appropriate, by email. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, please discontinue use of the Service.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which PromptQuestAi operates, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the courts of the applicable jurisdiction.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PromptQuestAi regarding the Service and supersede any prior agreements or understandings.
